Terms and Conditions – WAIS (WhattA Artificial Intelligence Services)

These Terms and Conditions (“Terms”) govern the use of the WAIS platform and related services (“Service”) provided by Waix Technologies Sdn. Bhd. (“WAIS” “we,” “us,” or “our”). By accessing or using WAIS, you (“user,” “you,” or “your”) agree to comply with these Terms.


1. ELIGIBILITY AND ACCEPTANCE OF TERMS

1.1 By signing the Service Agreement or using the Service, you accept these Terms in full. If you do not agree, you must not use the Service.

1.2 These Terms form a legally binding agreement between you and WAIS.

 

2. ACCOUNT REGISTRATION AND SECURITY

2.1 You must register an account via WAIS website to access certain features of WAIS.

2.2 You are responsible for maintaining the confidentiality of your account credentials.

2.3 Any activity under your account will be deemed authorized by you.

2.4 You must notify us immediately of any unauthorized access or breach of security.

 

3. SCOPE OF SERVICE

3.1 WAIS provides an AI-powered chatbot solution with automation, analytics, and integration features, as described in the Service Agreement.

 

4. USER OBLIGATIONS AND ACCEPTABLE USE POLICY

4.1 You agree to use WAIS only for lawful purposes and in compliance with applicable laws.
4.2 You must not:

  • Use WAIS to transmit unlawful, harmful, or offensive content

  • Reverse engineer, decompile, or attempt to access source code

  • Use WAIS in a way that disrupts its performance or security

4.3 We reserve the right to suspend accounts in case of breach of these obligations.

5. DISCLAIMER OF WARRANTIES

5.1 The Service is provided “as is” and “as available,” without warranties of any kind.

5.2 We do not guarantee uninterrupted, error-free, or 100% secure operation.

5.3 Any reliance on WAIS outputs is at your own risk.

 

6. INTELLECTUAL PROPERTY RIGHTS

6.1 All intellectual property in WAIS, including software, content, and trademarks, remains the property of WAIS.

6.2 You may not copy, modify, or distribute any part of WAIS without prior written consent.

 

7. THIRD-PARTY LINKS AND RESOURCES

7.1 WAIS may contain links or integrations with third-party services.

7.2 We are not responsible for the content, security, or availability of such third-party resources.

 

8. SUBSCRIPTION TERMS AND PAYMENT POLICY

8.1 Fees:

  • Setup Fee: RM8,000 (one-time, per account)

  • Subscription Fee: RM4,200/month per line

8.2 Fees are billed in advance according to your chosen billing cycle.

8.3 Late payments may result in suspension or termination of the Service.

 

9. CANCELLATION, NO REFUND POLICY, AND TERMINATION

9.1 All payments made are non-refundable, except where required by law.
9.2 You may cancel your subscription by giving 60 days’ written notice.
9.3 We may terminate the Service immediately if you:

  • Breach these Terms

9.4 Upon termination, your access to WAIS will be disabled.

 

10. COPYRIGHT POLICY AND TAKEDOWN PROCEDURE

10.1 We respect intellectual property rights and will act on valid infringement notices.

10.2 If you believe your content has been used unlawfully, please contact [management@waix.uk] with sufficient evidence.

11. INDEMNIFICATION

11.1 You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your misuse of WAIS

  • Your violation of these Terms

  • Infringement of third-party rights caused by your use of WAIS

 

12. GOVERNING LAW AND DISPUTE RESOLUTION

12.1 These Terms are governed by the laws of Malaysia.

12.2 Any disputes shall first be resolved through negotiation in good faith.

12.3 If unresolved, disputes will be referred to arbitration in Kuala Lumpur, Malaysia.

 

13. AMENDMENTS AND UPDATES

13.1 We may update these Terms from time to time, with prior notice.

13.2 Continued use of WAIS after updates means you accept the revised Terms.

 

14. ENTIRE AGREEMENT AND SEVERABILITY

14.1 These Terms, along with the Service Agreement, constitute the entire agreement between you and WAIS.

14.2 If any provision is found invalid, the remaining provisions will remain in full force.
